Contract for Mailbox Service
This Agreement, made between the mailbox customer, hereinafter referred to as “Applicant,” and Signature Postal, hereinafter referred to as “Mail Service,” shall be governed by the following terms, to which each party agrees:
1. Appointment of Agent and Mailbox Rental
By completing this form and USPS Form 1583, which will be made available to the United States Postal Service (USPS), Applicant appoints Signature Postal as agent for the receipt of mail and packages through common carriers for a period not to exceed that for which rent has been paid in advance. Applicant agrees to:
- Pick up mail and other shipments at least once each week or make suitable arrangements, in advance, with Mail Service.
- Use the mailbox address designation “PMB” or “#” only. The USPS may refuse delivery without this designation.
- Mail Service will provide a mailbox key to Applicant for access during posted business hours. Possession of a key by another party shall be deemed authorization to collect mail.
2. Key Deposit and Replacement
- The key loaned to Applicant remains the property of Mail Service and may not be duplicated or modified.
- A refundable $10 cash deposit may be required for the key.
- The deposit shall be refunded upon return of the key within ten (10) days of service termination.
- Lost key replacement fee: $15 per key.
3. Liability and Delivery Responsibility
- Once mail or shipments are placed in Applicant’s assigned mailbox, they shall be deemed delivered. Mail Service shall not be liable for loss, theft, or damage.
- Notices for oversized packages will be placed in the mailbox. Signature is required upon pickup.
- Mail Service does not guarantee timely or undamaged delivery by USPS or other carriers.
4. Compliance with Regulations
Applicant agrees to:
- Use services in compliance with Mail Service rules, USPS regulations, and local, state, and federal laws.
- Understand that violations may result in immediate service cancellation without notice, refund, or mail forwarding.
5. Confidentiality of Applicant Information
Information provided by Applicant shall remain confidential unless disclosure is required by law enforcement or postal operations. Law enforcement includes all city, county, state, or federal agencies.
6. Multiple Recipients and High Volume Policy
- Mail and shipments will not be accepted for more than three (3) persons or organizations per mailbox without prior written approval. Each additional recipient must:
- Complete USPS Form 1583
- Provide approved identification
- Sign a mailbox contract
- Additional fees apply for each business name receiving mail.
- If Applicant consistently receives a higher volume than the mailbox can accommodate, Mail Service may:
- Require rental of a larger mailbox or additional boxes
- Assess additional fees
- Terminate the service for unusually high volumes
7. Package Pickup and Disposal Policy
- Applicant must retrieve oversized packages within 24 hours of delivery.
- Packages not retrieved within 30 days may be disposed of at Mail Service’s discretion.
- Only common carrier deliveries are accepted; truck line deliveries are prohibited.
- No hazardous, illegal, or dangerous materials will be accepted. Violations will result in termination and potential reporting to authorities.
8. Payment Terms and Late Fees
- Mailbox rentals are monthly, and fees are due in advance by the due date stated on the invoice.
- A $10 late fee applies if payment is not received within five (5) days of the due date.
- Failure to pay within 15 days may result in service suspension. After 30 days of non-payment, service will be terminated.
- No refunds are provided for mid-term cancellations.
9. Unclaimed Mail and Forwarding Policy
- Upon termination, Mail Service shall not make mail available without prior payment of owed fees.
- Mail Service will retain mail for 180 days post-termination, subject to USPS DMM 508 1.8.3 regulations.
- Forwarding requests must be made in writing, accompanied by applicable fees.
- This constitutes a “Do Not Forward” agreement per USPS DMM 508.1.8.3.b.
10. Liability Limitations
- Applicant agrees to indemnify and hold Mail Service harmless from all claims related to service use.
- Mail Service liability for service disruptions is limited to the rental fees for the period of disrupted service. No liability exists for incidental or consequential damages.
11. C.O.D. and Restricted Deliveries
- C.O.D. deliveries will be accepted only with full, advance payment.
- Restricted deliveries require prior written permission on USPS Form 1583 (Block 5).
12. Service Disruptions and Emergencies
- Mail Service is not responsible for delays or disruptions caused by events beyond its control, including but not limited to natural disasters, power outages, or transportation strikes.
13. Updates to Applicant Contact Information
- Applicant must promptly notify Mail Service of any changes in contact details.
- Mail Service is not liable for missed communications due to outdated information.
14. Digital Notification Disclaimer
- Digital notifications (email, text) for package arrivals are provided as a courtesy. Applicant remains responsible for timely retrieval of mail regardless of notification status.
15. Governing Law
This Agreement shall be governed by the laws of the State of North Carolina.
